When you use, enter, browse this Website and register as a user of this Website, this means you have agreed the terms and condition, with disclaimer, of this Website.

Description of Services

This Website provides the services of an online knowledge management and sharing platform (“the services”) for the users. The e-Platform is funded by the Social Welfare Department (“SWD”), and operated by The Hong Kong Council of Social Service (“HKCSS”).

You understand and agree that the services consist of delivering some messages by this Website, for example, announcement relevant to the services, administrative message, enquiry and discussion regarding the projects, those correspondences are part of the services which cannot be disabled.

Unless there are explicitly other statements, any new functions and enhancements for the services (including any new products) are covered by the terms and condition of the services. This Website reserves the rights to suspend all or part of the services for maintenance and repair, system update and any other tasks e-Platform thinks appropriate, without needing to give prior notice. You understand and agree that the services are delivered on an “as is” basis, that is, this Website is not responsible for issues such as the user-side communication, settings of personalization, data deletion, error on message delivery and data not saved, etc. You have to acquire the services at your own costs, including the costs related to any third party provider, such as the fee of Internet access or any charges per usage duration. Besides, you have to provide and be responsible for all the devices and equipment which are necessary for acquiring the services.

Usage of Services

In order to use the services, you have to consent to the following terms:

1. The information provided during user registration in this Website is correct, accurate, up-to-date and complete.

2. You have to maintain and update the information given during user registration from time to time, in order to ensure the correctness, accuracy and completeness of the information. If you provide any incorrect, false, biased, incomplete and misleading information, or we reasonably suspect that your provided information is incorrect, false, biased, incomplete and misleading, we reserve the right to suspend or terminate your user account, and reject you to use all or part of the services for the time being and in the future.

3. You have kept the login password of this Website and other registration information confidential and safe. You agree to notify HKCSS immediately, once your login password and information are used and accessed by any other persons without authorization.

4. This Website is designed mainly for the Non-governmental Organizations ("NGOs") to share the knowledge and experience of Social Welfare Development Fund ("SWDF") projects, the NGOs should not open the platform to any third party persons and companies, such as creating user accounts for them or disclosing the information obtained from the Website to them, especially for the use of commercial and promotional activities.

5. When you express your opinion or post any information to this Website, please be aware of not violating any existing Non-disclosure Agreement(s) between any third party persons/ companies and you, or forming slander to any third party persons/ companies.

Intellectual Property

You agree to obey the Intellectual Property Law of the Hong Kong Special Administrative Region as follows:

1. You agree not to perform any activities which will infringe the Intellectual Property Law; or harm or cause damage to the intellectual properties and/ or patents of any information of the WebSite. You also agree not to link the Website with any external websites with the activities of infringing intellectual property. Activities of infringing intellectual property include:

Infringe any copyrights, trademarks, patents or other intellectual property or exclusive rights (“intellectual property”);

Do any actions which are against the protection of intellectual property, including modifying serial number or registration number, or using any hacker tools;

Without proper authorization and consent, use whatever ways to copy, extract or use the contents of others’ web pages;

Supply the file(s) or link(s) of any pirate copies of intellectual properties.

In case we discover any activities which infringe the intellectual properties of others, HKCSS reserves the rights to take the following actions, without needing to give prior notice, and HKCSS shall not be held liable in respect of any legal liability and right of recourse:

Remove any posts, contents or information from this Website, which infringe any intellectual properties, or the Intellectual Property Law, directly or by all other means;

Terminate the login account and registration of the user, and consider taking any legal actions.

Disclaimer

1. The information provided by HKCSS on e-Platform is for general reference only. Whilst HKCSS endeavours to ensure the accuracy of the information, no express or implied warranty is given by HKCSS as to the accuracy of the information.

2. To facilitate users to access the information, e-Platform may provide or assist in providing links to external websites through its pages. Provision of, or assistance in providing these links gives rise to no statement, representation or warranty, express or implied, that HKCSS agrees or does not disagree with the contents of such external sites. HKCSS will not have or accept any liability, obligation or responsibility whatsoever by any loss, destruction or damage, however arising from or in respect of any use or misuse of or reliance on the contents of any such external websites delivered on or via e-Platform.

3. e-Platform uses translation software to translate the Traditional Chinese version into Simplified Chinese version. In case of discrepancies between these two versions, the Traditional Chinese version shall prevail.

4. HKCSS expressly states that it has not approved nor endorsed the information contained in or in connection with the Websites. HKCSS does not accept any responsibilities for any loss or damage whatsoever arising from any cause whatsoever in connection with the Website. HKCSS is entitled to delete, suspend or edit all information on this Website at any time at its absolute discretion without giving any reason. Users are responsible for making their own assessments of all information contained in or in connection with the Website and are advised to obtain independent advice before acting on it.

5. By using e-Platform, you agree to accept unconditionally the terms of this Disclaimer and as they may be revised and/or amended from time to time by the HKCSS and e-Platform without prior notice to you. Please check this page regularly for any revisions and/or amendments which may be made.
